HC acquits two in gang rape case

The Gujarat high court has quashed the 20-year jail term given to two persons in Panchmahal district in a gang rape case, in which the victim delivered a child and abandoned the infant in a Rajasthan village.

In this important judgment, the HC considered the long delay in registration of FIR, negative DNA reports, and the court ruled that the presumption under the Protection of Children from Sexual Offences (POCSO) Act about the accused being held guilty until proved otherwise — is not absolute and is rebuttable.

In December 2015, three persons including Ajit Bhagora, Vajesinh Damor and Sanjay Damor were charged for gang rape of a 16-year-old girl in Morva police station. The FIR was filed two months after the rape victim delivered a child in Rajasthan.
